Wrongful Death

Wrongful Death Cases

Texas law permits surviving family members to recover for the wrongful death of a loved one caused by negligence, intentional acts, or strict liability.


  • Eligible plaintiffs: Spouse, children, parents (§71.004, Texas Civil Practice & Remedies Code). 
  • Recoverable damages: Pecuniary losses (financial support), mental anguish, loss of companionship, and burial expenses. 
  • Statute of limitations: 2 years from date of death (§16.003).
